LEGAL PROTECTION OF INVESTORS AGAINST BNI INTEREST FUND INTERESTS DEFAULTS ACCORDING TO LAW NUMBER 8 OF 1995 CONCERNING CAPITAL MARKETS

Abstract:

This research was conducted to find out how legal protection to investors according to Law No. 8 of 1995 and how to settle investor complaints related to the return of the amount of the investment in the BNI Fund for Flowering Funds.

This research is a normative law research (legal research), the approach method used in research is the conceptual approach (conceptual approach), the statutory approach (case approach), the case approach (case approach). Legal material collection techniques are carried out by means of documentation study. The analysis used in this study is prescriptive analysis, namely the nature of this analysis is intended to provide an argument for the results of research that has been done.

The results obtained from this study are that legal protection for investors against mutual funds is still not optimal. This can be seen from the fact that the provisions of Law No. 8 Th. 1995 concerning Capital Market in completing defaults conducted by mutual funds and Settlement against the defaults of BNI Funds for Interest Funds is not made explicitly, it is known from the fact that no compensation was given to the injured investor.
